I handle DWI and DUI cases all over New York State, most frequently appearing in Albany, Rensselaer, Saratoga, Schenectady, and Columbia Counties. My main office is located in East Greenbush NY only 3 miles from downtown Albany. Parking is much more convenient where I am and we are easy to find. I have satellite offices in Albany and Saratoga Springs as well.
DWI defense is a complex matter in New York State, and what may happen in your case can be heavily dictated by where you were arrested. Courts and district attorneys vary in how they approach these cases. I am familiar not just with the law, but also the important nuance of how locality matters. Arrests in Colonie, Guilderland, East Greenbush, Schodack, Kinderhook, Clifton Park, or Malta, can all produce different results on the same basic facts. The important thing is I know how the different judges and DAs in these towns and cities handle DWI cases, maximizing our chances of getting the best result possible.
DWIs are difficult situations – you’ve been arrested, possibly given a breath test or blood sample, and the police claim you were intoxicated. To many people, these cases are treated as open and shut.
That’s not the case however. You have legal rights that are not thrown out the window because the police say you were drunk. The police, DA, and Courts all have rules that apply to them too, and if they don’t follow these rules, your case can be dismissed or reduced significantly. I make this my goal with every case I take on and will do the same for you.
The District Attorney has the burden of proof in every case. I make it as difficult as possible for them to meet that burden, always fighting for your interests and making sure your rights are protected.
One of the toughest things about a DWI charge is loosing the ability to drive. The law allows a judge to take your licence simply because you’re accused of driving while intoxicated. There are very specific rules and procedures that the police and courts must follow to take your licence before you are convicted. I have had much success preventing that from happening for my clients. It is not uncommon for paperwork errors and filing issues to pop up, but these issues are tricky and can rely on not always obvious things like whether or not documents the court has are photocopies. I know all of the rules relating to suspension of your driving privileges pending prosecution and will make sure you don’t lose your licence when you should not. Even if you are suspended there are rules that allow you to keep driving in many situations. I will do everything possible to make sure you can still drive as necessary.
